David Vallas is a partner in the Restructuring & Insolvency practice group of Wildman Harrold. He concentrates his practice in the areas of creditors’ rights, bankruptcy and general commercial litigation.

Representative Experience:

  • Represents owners of shopping centers in connection with their day-to-day operational problems and business issues
  • Successfully enforced the terms of a lease against an international retailer; following a trial on the merits, the court entered a permanent injunction and awarded the shopping center client its fees and costs. 900 N. Michigan Ave. LLC v. L’Occitane, Inc., Cook County, Illinois 2006
  • Represented a debtor in its resistance of a foreclosure action against a valuable piece of commercial real estate; despite the maturity of the debt in late 2002, the entry of the foreclosure judgment was forestalled until the middle of 2005; the two-year deferral of the foreclosure judgment and sale enabled the developer to sell the real state in a non-distressed market transaction for a sizable profit
  • Obtained summary judgment for a developer of commercial real estate to quiet title to the property free and clear of a $3.7 million broker’s lien
  • Represents national insurance companies and their affiliates to enforce commercial insurance policies
  • Represented the liquidating trustee in a Chapter 11 bankruptcy case in connection with preference actions and resolving creditors’ claims
