Lisa S. Simmons

Lisa Simmons is a partner in the Litigation Department of Wildman Harrold. A business-focused outside counsel, she supports her clients in resolving complex commercial disputes, both in and out of court, with particular experience in the defense of class actions. Some of Lisa’s recent matters have included the defense of insurance, medical device, and chemical companies in putative class action lawsuits alleging consumer fraud and other claims. In addition, Lisa has extensive appellate experience, including appeals arising from high-profile cases brought by governmental entities against firearms and lead pigment manufacturers.

Representative Experience:

  • Represents blood glucose manufacturer in class action and federal False Claims Act cases arising from the sales and marketing of blood glucose monitors. Obtained removal of the case from Madison County, Illinois to district court on a novel jurisdictional theory and, thereafter, dismissal of several of the alleged claims. Following remand to state court after federal claims were dismissed, obtained summary judgment in favor of client. Thereafter, obtained dismissal of False Claims Act complaint based on similar allegations, which was affirmed by Eighth circuit on appeal.
  • Represents insurance companies in class action and other cases arising out of the sales and marketing of various types of insurance products; negotiates and implements complex nationwide class action settlements and counsels clients on preventative measures to avoid or mitigate class actions
  • Represents insurance companies in complex collection matters relating to retrospective and deductible workers’ compensation programs and claims handling under those programs
  • Regularly counsels clients concerning claims arising from implementation of software programs; most recent matter involves a claim pending in Dutch courts on behalf of a global conglomerate to recover damages resulting from multi-million dollar overruns on an enterprise-wide software implementation project
  • Represented varied clients in large joint defense groups in appeals arising from novel claims seeking to hold industry groups liable for criminal and negligent conduct of third parties. Was a member of committee responsible for drafting appellate briefs and motion papers. Recent decisions include: City of Chicago v. American Cyanamid Co., 355 Ill. App. 3d 209 (1st Dist.), appeal denied, 2005 Ill. LEXIS 756 (Ill. May 25, 2005); City of Chicago v. Beretta U.S.A. Corp., 213 Ill. 351 (Ill. Nov. 18, 2004); City of St. Louis v. Cernicek, 145 S.W.3d 37 (Ct. App. Mo. 2004).

Personal Information:

Raising two young boys in the City of Chicago with her husband, John Street, also a partner at Wildman Harrold, Lisa agrees that “it takes a village” and believes it is important to identify ways in which law firms can help working parents balance their responsibilities. As an active member of the firm’s Women’s Initiative, Lisa led the effort to restructure the firm’s “balanced hours” policy in 2006 and is actively engaged in assisting the firm in its Chicago Bar Association’s Alliance for Women Call to Action activities.
