Representative Experience:

  • Routinely handles all aspects of legal compliance for national, regional and local sweepstakes, skill contests, trade, charitable, reality television and other promotions (including drafting official rules, reviewing ad copy, attending to applicable state registrations, and drafting affidavits and participant releases).
  • Analyzes ad copy (print, TV, web, mobile, packaging, etc.) for claim substantiation and compliance with applicable laws, rules, regulations and self-regulatory guidelines.
  • Counsels clients on the legal aspects of social networking web sites, viral marketing campaigns and marketing to wireless devices (including text message campaigns).
  • Represents clients in connection with co-promotion arrangements, strategic alliances and sponsorship deals.
  • Drafts and negotiates all agreements affecting marketing campaigns, including ad, promotion and pr agency agreements, media buying/planning agreements, and talent and spokesperson deals.
  • Counsels clients on user-generated content issues, including Communications Decency Act and Digital Millennium Copyright Act compliance.
  • Significant experience in privacy, consumer protection, web site vetting and e-commerce issues, including drafting web site policies and terms.
  • Negotiates and drafts contracts in such areas as web site development, hosting, content and music licensing, as well as software licensing and other e-commerce and technology transactions.
  • Negotiates and drafts deals in the motion picture, music, theater, television, book publishing and print media industries.
  • Advises clients on traditional intellectual property issues including copyrights, trademarks, rights of publicity and trade secrets.
