John A. Roberts
John Roberts is a partner in the Litigation Department of Wildman Harrold. He was recently named an Illinois Super Lawyer in Litigation, an honor bestowed on only the top 5% of Illinois lawyers. John serves as national and regional litigation counsel for numerous Fortune 500 pharmaceutical, medical device, and medical equipment companies. For these industry leaders, John coordinates, sets the strategy, and litigates lawsuits brought against these companies from the initiation of the complaint through trial. He also litigates complex commercial matters for a Fortune 30 pharmaceutical distributor and litigates class action and product liability matters for an industry-leading window manufacturer. In addition to his litigation practice, John counsels a variety of health care entities on a diverse array of regulatory, transactional, and administrative matters. John serves as general counsel for numerous durable medical equipment suppliers, health systems, ambulatory surgical centers, and medical group practices located throughout the United States. Besides litigating numerous commercial matters, including disputes involving health insurance and managed care contracts for these entities, where he has often recovered significant damage awards, he also provides these clients with Stark, fraud and abuse, and HIPAA compliance counseling.
Representative Experience:
- As lead counsel, successfully represented a physician group practice before the Illinois Supreme Court, winning the argument that an uncertified professional corporation may enforce its contractual right to direct payment from a major health insurance company making law in this emerging area of practice, Chatham Foot Specialists, P.C. v. Health Service Corp. d/b/a Blue Cross Blue Shield of Illinois, 216 Ill. 2d 366, 837 N.E.2d 48, 2005 Ill. LEXIS 965, 297 Ill. Dec. 268, 2005
- National coordinating counsel for a Fortune 200 pharmaceutical manufacturer in its defense of numerous lawsuits brought against the company throughout the United States and Puerto Rico alleging compensatory and punitive damages from the alleged ingestion of a contaminated anti-inflammatory medication
- Regional counsel for a Fortune 350 medical device manufacturer in its defense of high-stakes product liability matters involving cardiac pacemaker, defibrillator, and catheter products
- Represent industry leading window manufacturer in its defense of numerous class action lawsuits seeking compensatory and punitive damages for alleged consumer fraud, successfully defeating plaintiffs’ attempts to certify both national and state consumer classes
- Won on appeal an outpatient surgical facility’s right to maintain an action to recover millions of dollars worth of fees promised to the surgical facility by a large health insurance company, Chatham Surgicore, Ltd. v. Health Care Service Corp. d/b/a Blue Cross Blue Shield of Illinois, 356 Ill. App. 3d 795, 826 N.E.2d 970, 2005 Ill. App. LEXIS 280, 292 Ill. Dec. 534, 1st Dist. 2005
- Successfully defended a Fortune 30 pharmaceutical distributor, in a breach of contract action winning summary judgment, saving the company millions of dollars
- Health care regulatory counsel for leading public and private health care providers, including medical device manufacturers and suppliers, health care systems, ambulatory surgical treatment centers, nursing homes, long-term care facilities, and medical group practices in various fields. In this capacity, counsels clients on a variety of matters including development of HIPAA compliance programs; navigation of federal and state fraud and abuse laws; HIPAA and state patient confidentiality and consumer protection laws; state licensure statutes; certificate of need issues for acquiring, constructing, and financing health care facilities and/or major medical equipment; and various written agreements, including payor and employment contracts.
- Successfully defended numerous outpatient surgical facilities in actions brought by various insurance companies seeking to recoup millions of dollars in damages for alleged overpaid health claims
- Successfully recovered hundreds of thousands of dollars worth of fees owed to various outpatient surgical facilities and physician group practices by third-party payors
- Developed, counseled, and amended bylaws for a state nurses’ association
