Litigator Michael Dockterman Contributes to Best-Selling ABA Book on Attorney-Client Privilege

Rise of internal investigations in civil cases drives need for practical advice

Michael Dockterman, a prominent litigator and partner at the national law firm of Chicago-based Wildman, Harrold, Allen & Dixon LLP, contributed a key chapter to the best-selling American Bar Association book, “The Attorney-Client Privilege in Civil Litigation, Fourth Edition.”

Dockterman’s chapter is entitled “Protecting the Attorney-Client Privilege During an Internal Investigation.” Addressing the details of internal investigations in both civil and criminal matters, the chapter offers specific guidance, tools, strategies and precautions that in-house counsel and outside attorneys can use to ensure that the attorney-client privilege and attorney work product exemptions are maintained and not mistakenly waived during an internal investigation.

The book addresses corporate lawyers’ increased need for practical advice on maintaining the attorney-client privilege. The book’s high interest and fast success in the legal community can be attributed in part to the rise of internal investigations in civil cases, post Sarbanes-Oxley; and corporate practitioners’ quest for in depth, step-by-step understanding on how to manage these investigations and assess and respond to risks.

Dockterman has led corporate responses to investigations by the Department of Justice and numerous agencies including the Antitrust Division, the SEC, the Department of Defense, the Department of Commerce, and several US Attorneys. He has also conducted internal investigations for corporate clients on subjects including antitrust, accounting, healthcare, executive misconduct, and corporate theft.

He received his undergraduate degree from Yale University in 1975, and earned his J.D. from Duke University in 1978.
