Patrick R. Mueller
Patrick Mueller is an associate in the Intellectual Property group. He has experience counseling clients on legal issues related to data privacy and information security. Prior to law school, Patrick worked for five years in the information security field as a consultant, researcher and writer with a focus on network intrusion detection systems. As a senior security analyst at Neohapsis Labs, he helped develop an industry first, standards-based testing program for network security products. Patrick also worked for the internal risk management group of a multinational consulting company, providing network security auditing and penetration testing services. Since 2001, he has written for several industry publications, including Information Week, Information Security Magazine, Network Computing Magazine, and Privacy Journal.
Representative Experience:
- Counsels clients on a wide-range of privacy and security issues, including developing data breach response programs, developing information security and data privacy programs for compliance with a variety of legal requirements, drafting and implementing corporate policies, advising clients undergoing security or privacy-related audits, and addressing web site compliance, including drafting of web site privacy policies and terms of use
- Advises clients regarding data privacy compliance obligations, such as user-generated content issues, including complying with the online service provider provisions of the Digital Millennium Copyright Act (DMCA)
- Advises clients collecting credit card information on data security issues including those surrounding the Payment Card Industry Data Security Standard (PCI DSS)
- Counsels clients on marketing and database compliance issues, including compliance with the CAN-SPAM Act and the Children’s Online Privacy Protection Act (COPPA)
- Drafts and negotiates contracts for both vendors and customers including hosting, software licensing and web development agreements
