David Vallas is a partner in the Business Transactions department at Wildman Harrold. David focuses his practice in the areas of creditors’ rights, bankruptcy, real estate litigation, and general commercial litigation and regularly advises clients on workouts, restructurings and foreclosures. David counsels owners and managers of shopping centers in connection with their day-to-day legal and business issues. He represents national and local banks and other lending institutions, court-appointed receivers, and borrowers in real estate workouts and commercial foreclosure proceedings. David was named a 2010 Illinois Super Lawyer “Rising Star” in Business Litigation, Bankruptcy and Creditor/Debtor Rights. Inclusion in this listing is limited to less than 2.5% of lawyers under 40 years of age in the State of Illinois.
Representative Experience:
- Successfully enforced the terms of a lease against an international retailer. Following a trial on the merits, the court entered a permanent injunction and awarded the shopping center client its fees and costs.
- Represented a commercial developer in its resistance of a foreclosure action and successfully delayed the entry of the foreclosure judgment for more than two years, enabling the developer to sell the real state in a non-distressed sale for a sizable profit.
- Obtained summary judgment in favor of a commercial developer to quiet title to the property free and clear of a $3.7 million broker’s lien.
- Represents the developer of a housing development in a $92 million loan work-out.
- Advised a court-appointed receiver in connection with an apartment building under his supervision that caught fire.
- Counseled a licensor of intellectual property in the bankruptcy of its licensee proceeding to prevent the unauthorized assignment of the license.
- Enforces loan agreements against borrowers who seek bankruptcy protection, including obtaining relief from the automatic stay in Chapter 7 and 11 bankruptcy proceedings, resisting injunctions enjoining actions against guarantors of the obligations, and limiting the debtor’s use of cash collateral.
