Carole E. Handler

Carole Handler is a partner in the Intellectual Property Department of Wildman Harrold.  She has tried numerous entertainment, trademark, copyright, and antitrust cases in state and federal courts in California, New York and Pennsylvania. Her primary fields of practice are copyright in new media, antitrust, and the interface of antitrust and intellectual property.

Before joining Wildman Harrold, Carole was vice chair of the IP Litigation Practice at Foley & Lardner in Los Angeles where she also served as a member of the Trademark, Copyright & Advertising and Antitrust Practices, as well as the Entertainment & Media Industry Team. Prior to that, Carole was a partner at Thelen Reid & Priest in Los Angeles, where she was a co-chair of its entertainment and media practice. Previously, she was co-chair of the entertainment group at Kaye Scholer LLP.

Carole has been rated AV, the highest performance rating, in Martindale-Hubbell’s peer review rating system. She has been named one of the "Top Women Litigators in California" by Daily Journal Extra every year since 2002. In 2001, Carole was named one of the "Lawyers of the Year" by California Lawyer. In addition, she was selected for inclusion in the 2007 and 2008 editions of The Best Lawyers in America®, and in 2005, was featured in Super Lawyer magazine. In 2006, Carole was honored by AMIT as a Woman of Accomplishment. She is an adjunct professor of antitrust and intellectual property law at the University of Southern California and of copyright law at Rutgers University Law School. She has also taught at UCLA Law School. She speaks and writes widely on a variety of copyright and antitrust issues. 


Representative Experience:

  • Antitrust litigation involving motion picture licensing and distribution, energy, pharmaceuticals, medical devices and other industries 
  • Successfully represented Marvel Enterprises in its battle to reclaim the motion picture rights to its signature character "Spider-Man" and protecting the right to copyrighted characters in online gaming 
  • Established the motion picture industry's exclusive rights to control the distribution and performance of their copyrighted works in new media 
  • Successfully defended major motion picture studios against "block booking" claims 
  • Led a pro bono jury trial team on behalf of noted Holocaust rescuer Irene Gut Opdyke, who had been deprived of the rights to her life story
