Jesse M. Brody

Jesse Brody is an associate in the Intellectual Property Department of the Los Angeles office of Wildman Harrold. His practice focuses on legal issues impacting entertainment, technology, advertising and privacy. His experience includes advising companies in matters that involve traditional television and film, interactive games and new media matters such as privacy policies, terms of use, user-generated content, social networks, downloadable software and commercial text messages. He represents a broad range of clients including those in the industries of entertainment, new media, technology and consumer products.

Representative Experience:

  • Negotiates and drafts television and theatrical motion picture development, production and distribution agreements. 
  • Represents interactive game developers and publishers in connection with development, distribution and in-game advertising arrangements. 
  • Negotiates and drafts software licenses and website development and hosting agreements. 
  • Advises clients on all aspects of legal compliance for national and local sweepstakes, skill contests, trade, charitable, reality television and other promotions (including drafting official rules, reviewing ad copy, attending to applicable state registrations, and drafting affidavits and participant releases). 
  • Counsels clients on the legal aspects of social networking and user-generated content web sites (including Communications Decency Act advice), viral marketing campaigns and marketing to wireless devices. 
  • Represents clients in connection with co-promotion arrangements, strategic alliances, sponsorship deals and product placement, and integration arrangements. 
  • Drafts and negotiates all agreements affecting marketing campaigns, including, but not limited to, ad, promotion, pr agency and special event planner agreements and talent and spokesperson deals. 
  • Drafts and negotiates character, trademark, music, photo and clip licensing agreements. 
  • Performs copyright and trademark clearance of scripts, storyboards, ad copy and programming. 
  • Drafts and negotiates agreements in connection with a wide variety of intellectual property transactions such as: work-for-hire agreements, invention rights assignment agreements and licensing agreements of all sorts. 
  • Conducts website reviews for compliance with state and federal laws and drafts privacy policies, terms of use, end-user license agreements, user codes of conduct and DMCA policies. 
  • Represents licensors, licensees, manufacturers and distributors in the consumer products industry. 
  • Advises clients on traditional intellectual property issues including copyrights, trademarks, rights of publicity and trade secrets.
